Terms & Conditions
1. Scope
The following general terms and conditions (GTC) apply to all contracts concluded between the operator of the “Tesla-Protect” shop (hereinafter referred to as “provider”) and the customer (hereinafter referred to as “customer”). Differing, conflicting or supplementary terms and conditions of the customer do not become part of the contract, even if they are known, unless their validity is expressly agreed to in writing.
2. Contracting party
The purchase contract is concluded with the provider “Tesla-Protect” - DynamiLED GmbH.
3. Offer and conclusion of contract
The provider's offers in the online shop are non-binding and subject to change. The customer has the option of selecting products from the provider's range and placing them in the shopping cart. By submitting the order, the customer makes a binding offer to purchase the goods in the shopping cart. The provider will confirm receipt of the customer's order immediately. The confirmation does not constitute acceptance of the offer. The provider reserves the right to accept the customer's offer within 2 working days of receipt of the order. The contract is concluded when the provider accepts the customer's offer.
4. Right of withdrawal
The customer has a right of withdrawal. The details of this are explained in the provider's cancellation policy.
5. Prices and shipping costs
All prices are final prices and include statutory VAT. Shipping costs may also apply. The exact shipping costs are shown to the customer during the ordering process.
6. Payment
Payment is made using the payment methods offered at the checkout. In principle, shipping takes place after payment has been made. There may be exceptions to this in individual cases.
7. Retention of title
The goods remain the property of the provider until full payment has been made.
8. Warranty and liability
The statutory warranty rights apply. The provider is not liable for damage caused by improper use or handling of the goods.
9. Data protection
The provider's data protection regulations can be viewed on the shop's website.
10. Final provisions
If a provision of these General Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by one that comes closest to the meaning and purpose of the invalid provision in economic terms.
The law of the Republic of Austria applies. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and us is our place of business.
We reserve the right to change these General Terms and Conditions at any time and without giving reasons. The changes will be communicated to the customer by email at least two weeks before they come into effect. If the customer does not object to the validity of the new General Terms and Conditions within two weeks of receiving the email, the amended General Terms and Conditions shall be deemed to have been accepted by the customer. We will specifically draw the customer's attention to the importance of this deadline in the email notifying the changes.
